Shocking surveillance video captured the moment an Amazon delivery driver allegedly sucker-punched a 71-year-old man inside a California gas station after a heated argument over a parking spot.

The March 30 confrontation unfolded at an ARCO gas station in Elk Grove, California, where attorney Tony Buzbee says his elderly client was attacked after a dispute with a delivery driver.

Buzbee later shared surveillance footage of the incident, which appears to show the driver confronting the older man inside the store.

The man, wearing an Amazon jacket, can be seen getting in the 71-year-old’s face and allegedly threatening to “beat [his] a–” before striking him from behind.

The punch knocked the elderly man to the floor.

Footage shows him struggling to get back on his feet after the attack.

Authorities identified the suspect as Terrence Wheeler, 30, of Antioch.

Wheeler is facing charges related to felony elder abuse, felony criminal threats and misdemeanor battery, according to KCRA.

The 71-year-old victim is now suing both Wheeler and Amazon in civil court.

Buzbee said his client sought medical treatment for neck pain and a concussion after the incident.

He described the driver’s reaction as “hyper-aggressive.”

“We believe the Amazon driver has a history of violence,” Buzbee said.

The attorney, who unsuccessfully ran for mayor of Houston in 2019 against then-Mayor Sylvester Turner, also criticized Amazon’s screening and training practices.

“Amazon delivery folks must be carefully screened and trained,” Buzbee said. “Amazon must do better in the hiring process. When Amazon fails, like here, it must be held accountable.”

Buzbee said the lawsuit has been filed in the Superior Court of California in Sacramento County.

Amazon, however, said Wheeler was not directly employed by the company.

A spokesperson said the driver worked for an independent contractor that handled Amazon package deliveries.

After investigating the incident, Amazon said it turned its findings over to the third-party delivery company and banned Wheeler from delivering Amazon packages.

The case is now moving forward both criminally and civilly as the elderly man seeks damages over the alleged attack.
