A 20-year-old driver who struck and killed a young woman as she knelt in the middle of a road, apparently praying, has avoided jail despite admitting that he fled the scene of the fatal collision.

Ashton Friend was handed a suspended prison sentence in Adelaide, Australia, on October 9 for the death of Samia Malik, a 20-year-old international student from Pakistan.

The disturbing incident occurred around 11 p.m. on May 6, 2025, along North East Road in Hillcrest, a suburb northeast of Adelaide.

Surveillance footage presented in South Australia’s District Court showed Malik kneeling in the roadway for approximately four minutes before she was struck.

Judge Anne Barnett described the young woman’s hands as being positioned in what appeared to be a praying motion.

However, investigators have never established why Malik was kneeling in the middle of the road that night.

Friend, who was 19 at the time, was driving home from his girlfriend’s house when his vehicle struck Malik.

Instead of stopping to investigate, he continued driving.

His attorney, Jane Abbey KC, told the court that Friend did not initially realize he had hit a person. He heard a noise but believed he might have struck an animal, possibly a kangaroo.

The relatively minor damage to his vehicle reinforced that assumption, his defense argued.

However, prosecutors pointed out that other drivers had successfully avoided Malik before the collision. A police vehicle traveling behind Friend also managed to stop without striking her.

The court heard that Friend was checking his rearview mirror in the moments before the crash and failed to notice Malik in his path.

He was not speeding or under the influence of drugs or alcohol at the time.

According to evidence presented during sentencing, Friend had approximately 2.25 seconds to react after Malik became visible, leaving little opportunity to avoid the collision.

His failure to stop afterward became another central issue in the case.

Friend reportedly realized he might have been responsible after watching news coverage about Malik’s death. However, rather than contacting police, he remained silent.

His lawyer described him as overwhelmed and unable to come to terms with what had happened.

Investigators eventually identified Friend and arrested him approximately one week after the crash.

He later pleaded guilty to causing death by careless use of a motor vehicle and leaving the scene of an accident.

During an earlier court hearing, Friend apologized to Malik’s grieving family.

“I will have to carry my failures with me for as long as I live,” he said.

He acknowledged that he should have stopped and accepted responsibility for his actions.

Malik’s family, meanwhile, described the devastating impact of losing a young woman who had traveled to Australia hoping to build a better future.

In a victim impact statement, her sister, Qudsiya Malik, explained that the family’s grief had become a permanent part of their lives.

“Every important milestone reminds us that someone deeply loved is missing,” she said.

She described Samia as a cherished daughter, sister and friend whose future had been taken away.

Judge Barnett ultimately sentenced Friend to one year, three months and 29 days in prison, with an eight-month non-parole period.

However, the entire sentence was suspended, allowing him to remain out of prison as long as he complies with a two-year good behavior bond.

He was also disqualified from driving for 10 years.

In reaching her decision, the judge considered Friend’s young age, expressions of remorse, prospects for rehabilitation and the unusual circumstances surrounding the collision.

Both prosecutors and defense attorneys had supported a suspended sentence.

The ruling means Friend will not serve immediate jail time for Malik’s death, although violating the conditions of his suspended sentence could expose him to imprisonment.

For Malik’s family, the outcome comes after more than a year of grief and court proceedings.

And one haunting question remains unanswered: Why was the 20-year-old student kneeling in the middle of a busy road that night, with her hands appearing to be clasped in prayer?
