In a jaw-dropping move that raises more questions than it answers, Special Counsel Jack Smith announced on Monday that the Justice Department would drop its 2020 election case against President-elect Donald Trump. Smith, who has spent months insisting that the evidence against Trump was “rock-solid” and that “no one is above the law,” abruptly reversed course, citing legal and constitutional constraints.
But let’s not kid ourselves—this was never about the law. This was lawfare. A politically motivated crusade to take down Trump and cripple his chances at the presidency.
Smith’s explanation for dropping the case? The Office of Legal Counsel (OLC) determined that longstanding opinions barring the prosecution of a sitting president applied here. “The Department has determined that…this prosecution must be dismissed before the defendant is inaugurated,” Smith wrote in his filing.
He insisted the decision wasn’t due to a lack of evidence, stating the dismissal doesn’t “turn on the gravity of the crimes charged, the strength of the Government’s proof, or the merits of the prosecution.” Yet, in the same breath, he admitted that continuing the case would hinder Trump’s ability to lead.
A Legal Farce Unraveled
Trump’s indictment was always on shaky ground. Smith charged him for questioning the integrity of the 2020 election—a constitutionally protected right. The Supreme Court dealt Smith a major blow in July, ruling 6-3 that a president enjoys “absolute immunity” for actions within their official duties and “at least presumptive immunity” for all official acts. The ruling forced lower courts to reexamine whether Trump’s actions even qualified as prosecutable.
Rather than let the case die, Smith doubled down with a superseding indictment, desperate to keep the legal pressure on Trump during the 2024 campaign. But now, with Trump’s inauguration looming, the legal charade has collapsed under its own weight.
Trump Team Declares Victory
The Trump-Vance transition team wasted no time celebrating the DOJ’s retreat.
“Today’s decision by the DOJ ends the unconstitutional federal cases against President Trump and is a major victory for the rule of law,” said Trump communications director Steven Cheung. “The American people and President Trump want an immediate end to the political weaponization of our justice system and we look forward to uniting our country.”
The Political Witch Hunt Exposed
This isn’t just about Smith. Manhattan District Attorney Alvin Bragg, another player in the left’s anti-Trump legal offensive, also hit pause on his pursuit of the former president. On Tuesday, Bragg agreed to delay sentencing in the case accusing Trump of misclassifying payments to Michael Cohen as legal expenses rather than campaign expenditures.

Well time to throw them all in jail. Spending taxpayers dollars on a witch hunt. They should have to reimburse out of their own pockets. They have the money it came from us.
