A heartbreaking lawsuit claims Spirit Airlines abandoned a 75-year-old man with dementia at a busy Texas airport — leading to his horrifying death just hours later on a nearby highway.
According to the federal lawsuit, the family of Marcos Humberto Vindel Osorio says the elderly man was left confused and alone after arriving at George Bush Intercontinental Airport in June 2024.
His relatives claim they specifically warned Spirit employees before the flight that Osorio suffered from cognitive issues and would need assistance getting off the plane and navigating the airport safely.
The lawsuit says airline staff assured the family help would be provided.
But according to the complaint, that help never came.
Osorio had traveled from Palmerola International Airport in Honduras to visit loved ones in Houston.
Family members waiting at the airport reportedly became terrified when the 75-year-old never arrived at their planned meeting location after the flight landed.
As panic grew, relatives contacted authorities and began searching for him themselves.
A Customs and Border Protection officer later informed the family that Osorio had already cleared customs alone around 7:43 p.m., according to the lawsuit.
Hours later, tragedy struck.
More than three hours after disappearing inside the airport, Osorio’s body was reportedly discovered miles away along U.S. Route 59, also known as the Eastex Freeway.
The lawsuit claims the elderly man — apparently disoriented and wandering alone — had walked for nearly two hours before being struck and killed by multiple vehicles on the highway.
The family says the entire nightmare could have been prevented if the airline had simply followed through on its promise to help him.
“Spirit’s failure to provide the promised assistance… was the direct and proximate cause of Mr. Osorio’s death,” the lawsuit states.
Attorney Russ Brudner called the tragedy “every family’s nightmare.”
“This family has suffered an unimaginable loss,” Brudner said.
“They trusted an airline to keep their father safe for the last few miles of his journey home. That trust was broken in the most devastating way possible.”
The lawsuit says Osorio suffered from mild dementia that became worse under stress and unfamiliar surroundings, making supervision especially important while traveling alone.
According to the complaint, a relative personally explained Osorio’s condition to a Spirit Airlines agent during check-in, and the airline allegedly acknowledged the request for assistance.
The family says Osorio was even escorted to the departure gate in Honduras in a wheelchair before boarding the plane.
But after arriving in Houston, the lawsuit claims he was left to navigate one of America’s busiest airports entirely by himself.
Spirit Airlines declined to publicly comment on the ongoing litigation.
The airline is currently facing financial turmoil after previously filing for bankruptcy and beginning efforts to wind down operations.
The Osorio family is now seeking damages for wrongful death, emotional suffering, funeral expenses, and loss of companionship.
A pretrial conference in the case is reportedly scheduled for July 17.

Maybe this is a dumb question, but if the grandfather was in this type condition, then why would the family let him travel alone???
Yeah, relatives’ job to meet him as he disembarked and watch him…
Did this family get this in writing? If they provided a service like this there would absolutely be a charge. This man was the families responsibility not the airlines to babysit him. Take responsibility and don’t blame the airline especially since this man should never have traveled alone to begin with. So tired of people blaming others because they didn’t want to spend the money it would cost to have someone travel with him.
