Governor Greg Abbott of Texas has received a warning from the Department of Justice (DOJ) that if the state implements a recently enacted law permitting the prosecution and deportation of immigrants who enter the country from Mexico, the DOJ intends to sue the state. Abbott signed the bill earlier this month, and it will go into effect on March 5. It gives Texas law enforcement the authority to detain those they suspect of entering the country illegally. According to the DOJ, this state statute violates the constitution and impedes federal efforts to enforce immigration laws.

Texas’s Controversial Law:

In reaction to the spike in encounters with migrants at the southern border of the United States, Governor Abbott approved the measure. Any Texas law enforcement official who suspects someone of entering the country illegally may make an arrest under the new rule. After being detained, immigrants may be charged with misdemeanor illegal entry or they may consent to a judge’s order to leave the country.

Constitutional Concerns of the DOJ:

Principal Deputy Assistant Attorney General Brian M. Boynton contended that Texas’s new statute violates the Constitution and interferes with federal immigration enforcement activities in a letter to Governor Abbott. The letter made reference to Arizona v. United States, a 2012 Supreme Court decision that determined federal immigration rules frequently take precedence over state laws even when there isn’t a clear conflict.

The DOJ’s Demand:

According to the DOJ letter, “the United States will pursue all appropriate legal remedies to ensure that Texas does not interfere with the functions of the federal government” if Abbott does not notify them by January 3 that the state would stop enforcing the new legislation.

Governor Abbott’s Reaction:

In response to the DOJ’s warning, Governor Abbott resorted to social media, blasting the Biden administration’s opposition to Texas’s efforts and charging them with failing to enforce current immigration laws. “The Biden Admin. not only refuses to enforce current U.S. immigration laws, they now want to stop Texas from enforcing laws against illegal immigration,” stated Abbott on X, formerly Twitter, expressing his concerns. I’ve never witnessed such a strong opposition to the law in America. America is being ruined by Biden. Texas’s goal is to preserve it.”

Increase in Texas’s Immigration Laws:

The new law is a component of Governor Abbott’s larger plan to deal with the problems brought on by more immigration. Prior actions have included approving the construction of further border walls and transferring migrants to “sanctuary cities.”
