In a case that has shaken the nation to its core, the attorney for one of the illegal migrant suspects charged in the brutal murder of Texas 12-year-old Jocelyn Nungaray is now filing for a protective order. This move is a blatant attempt to shield his client from the negative media attention that has rightfully followed this horrific crime. The attorney claims that the intense scrutiny could prevent his client from receiving a fair trial. But let’s be clear: the real issue here isn’t media coverage—it’s the heinous crime committed and the broken system that allowed these men to slip through the cracks.

Two Venezuelan nationals, 21-year-old Johan Jose Martinez-Rangel and 26-year-old Franklin Jose Peña Ramos, have been charged with capital murder after Nungaray was found strangled to death in a Houston creek on June 17. These men reportedly crossed illegally into the U.S. earlier this year, a fact that adds another layer of outrage to this already heart-wrenching case.

Now, Peña’s attorneys are seeking a protective order to prevent law enforcement, forensic officials, and court personnel from making any statements to the public about the case. They argue that media attention could lead to “undue prejudice” and deprive Peña of a fair trial, a right guaranteed by the Texas Constitution and the U.S. Constitution.

Really? Undue prejudice? What about the rights of Jocelyn Nungaray, a 12-year-old girl who had her entire life ahead of her? What about the rights of her grieving family? It’s hard to muster much sympathy for Peña when you consider the fact that this man, who should never have been in this country in the first place, is now demanding protection from the very system he so egregiously violated.

Harris County District Attorney Kim Ogg didn’t mince words when she called this a “horrific crime” and pointed to the broken immigration system that allowed these men to roam free. Peña’s attorneys, of course, took issue with this, claiming that such statements would create bias against their client. But isn’t the real bias here against the American people, who are continuously put at risk by a system that prioritizes the rights of illegal immigrants over the safety of its citizens?

The fact that Peña was even out on the streets is a failure of epic proportions. One of these men was reportedly wearing an ICE ankle monitor—a flimsy attempt at supervision that clearly failed to prevent this tragedy. Jocelyn’s mother, Alexis Nungaray, spoke out during Trump’s recent visit to the southern border, expressing her grief and outrage that these men had been released in the first place. “They shouldn’t have been released,” she said, highlighting the 300 detention beds that could have held these suspects. But instead, they were let loose, and now a family is shattered forever.

Former President Trump, during his visit, offered comfort to Jocelyn’s mother, but no amount of comfort can bring her daughter back. This tragedy serves as a stark reminder of the real-world consequences of our lax immigration policies. How many more innocent lives will be lost before we get serious about securing our borders and enforcing the law?

As the legal wrangling over this protective order plays out, one thing is clear: the American people deserve better. They deserve a government that prioritizes their safety and upholds the rule of law. This case isn’t just about one brutal murder—it’s about the broader failure of a system that allows dangerous individuals to slip through the cracks and wreak havoc on our communities.

Jocelyn Nungaray should be alive today, and her family shouldn’t be left to pick up the pieces while the media debates the so-called rights of her killers. The real injustice here is that these men were ever given the opportunity to commit such a heinous crime. It’s time for America to wake up and demand accountability—from our leaders, from our justice system, and from anyone who dares to defend the indefensible.
